Affidavits

A statement that is written then confirmed by an oath or affirmation. For an affidavit to be admissible, you need a notary to verify the signatures and confirm that the signatures were done voluntarily and without force.

Power of Attorney

Gives one the authority to act on the behalf of someone in an either legal or financial matter. For it to be legally binding, one needs a notary public to confirm the identity, ensure they are signing voluntarily, and witness the signing.

Apostille

Apostilles are used for documents going to one of the 156 countries that are apart of the Hague Apostille Convention. A notary public must notarize the original document before sending it to the secretary of state for an apostille.

Will

A legal document expressing how one’s properties should be distributed after their death. Having a notary public notarize the will helps eliminate the need for two witnesses and makes it self-proving. In addition, it also helps speed up the process.

Pre-marital

Typically, a contract drafted between two people before they are married. For the agreement to be considered valid in New jersey, the written document must be signed by each spouse and notarized by a notary public.

Mortgage

This is an agreement between a homebuyer or refinancer and their lender. This serves as a security instrument for the lender. For the mortgage to be recorded and validated, it must be signed and notarized by a notary public.

Custody Agreement

An agreement between a set of parents that directly discusses how they will co-parent. Having the document notarized by a notary public legitimizes the contract. If needed, can be used as evidence if problems arise.

Disposition

Many may not know this, but notary publics can now perform notarial acts on copies in NJ! To prove that a document is a true and the correct copy, one needs a notary public to certify the paper or electronic document with their stamp.

Frequently Asked Questions

What is a Notary Public?2022-09-22T00:31:38+00:00

A notary public is a public servant who is appointed by a government authority and constituted by law in matters usually related to financial transactions, estates, powers-of-attorney, and international businesses.

What do Notary Publics do?2022-09-22T00:31:45+00:00

Their main duties are to validate signatures of people for the purpose of signing a document, authenticate the execution of certain documents, administer oaths and affirmations, take acknowledgements, take affidavits and statutory declarations along with other official acts depending on their state laws.

What are the different notarial acts?2022-09-22T00:31:59+00:00

There are 5 types of notarial acts most notary publics can administer which are Acknowledgements, Jurats, Oath or Affirmations, Signature Witnessing and Copy certification.

What is the difference between the notarial acts?2022-09-22T00:33:33+00:00

Please note that a notary public can never advise which notarial wording is required for your signing needs, but instead the signer must provide the appropriate wording/certificate, which is why it’s important to know the difference between the five.

  • Acknowledgements: A notary public’s main duty is to confirm the signer’s identity and their willingness to sign. These are often used for documents about assets like a loan contract or a deed to a house. A signer is not required to sign in front of the notary public, but notarization must occur in front of the signer.
  • Jurat: This compels a signer to swear that the contents of the document are true. Usually performed on depositions or affidavits. For a Jurat, the signer must sign in front of the notary public. Additionally, the notary public must administer an oath or affirmation. (Signer gets to choose which one)
  • Oath or Affirmation: Compels signers to be honest about the contents of the document provided. Lying in an oath or affirmation often can lead to legal consequences. Typically done on affidavits and depositions.
  • Oath: A sacred solemn promise to a higher power | Affirmation: A pledge on the individual’s personal honor
  • Signature Witnessing: Like an acknowledgement, this certifies a signer’s identity and signature. The difference between this an acknowledgement is the signer must sign the document in the presence of a notary public.
  • Copy Certification: Confirms that that a copy document is exact, true, and accurate to the original form. The original document must be provided.
Notary Publics VS. NSA (Notary Signing Agent)2022-09-22T00:34:02+00:00

They both can perform notarial acts, but a Notary Public officer is commissioned to witness and verify the signing of documents. A Notary Signing Agent in addition to notarial acts provides essential services for legal transactions such as loan signings. NSA’s assists with the overall signing of the entire package, not just the pages that needs notarizations. They also have a better understanding what information can be found of each page of the loan package.

Structured settlements: what are they and why do I need a Notary?2022-09-22T00:34:18+00:00

A negotiation usually pertaining to a financial arrangement where the petitioner agrees to resolve a claim settlement related to personal injuries under certain payment terms in a written document. A Notary Public is required to verify the signatures and identity on these agreements.
